And how many ground level, Kriegsmarine, and Luftwaffe soldiers were tried? It the leadership that was tried, not the soldiers. But back to Iraq, you are oversimplifying and ignoring the context and specifics of the war. The evidence, rhetoric and justification was about a preemptive military strike against Iraq especially with the danger of its supposed nuclear program and materials. Preemptive war is perfectly legal under international law and is the right of every sovereign nation. It is expressly not aggressive, it is a defensive war started against the potential aggressor before they can actually start the war. Just look at the Six Day War. As I've previously mentioned, the problem is that international law isn't specific enough about the threshold level that threat must meet to allow preemptive war and the timeline for the preemptive war in relation to the war it's supposed to prevent. And even though we know now that all the evidence against Iraq was bullshit and Cheney and Bush pretty much knew from the start of intelligence gathering, the soldiers sent to Iraq did not know this and thus were acting in good faith as soldiers fighting a preemptive war. But it's more complicated than that, especially with the Cheney Doctrine, which includes the 1% doctrine that even the most minimal intelligence or support for a potential threat is enough to meet the threshold to justify a preemptive war. Again, this is technically legal under international law as long as the leaders of the nation legitimately think that the evidence is real. In summation, all of this is a lot more complicated than "Iraq is a bad war and I don't like it, so all the US soldiers fighting it are criminal accomplices." You should be ashamed of yourself for comparing US soldiers to the Nazis. |

Why should you have to lose lives before you defend yourself? It's just like shooting a guy pointing a loaded gun at you. Why should you have to wait until after you get shot to stop him? |

But see, that's the dispute. The Bush Administration wasn't necessarily advocating for preventative war, they were trying to determine more concrete definitions of the terms of action for preemptive war. It is somewhat of a nebulous issue, especially when WMDs and terrorists are concerned. I mean, terrorists are by definition in violation of the Geneva Conventions for a multitude of reasons when they are being used and supported by a state like Afghanistan, including not wearing some form of uniform or identifying markings, not carrying weapons openly, hiding within civilian populations, etc. With Iraq, it wasn't necessarily a preventative war because war wasn't the the immediate and only reaction to the supposed threat caused by Saddam. The Bush Administration made it clear that the violations of UN resolutions were the first step in Saddam's threat and his abiding by those lawful Resolutions would prevent war. They cited his history of flaunting these resolutions and other attempts to minimize the threat caused by Saddam's regime and thus framed the war debate as one of the progressively harsher responses to the Saddam threat and a necessary event given the failure of the previous responses. I don't agree with the Iraq War, especially not with the way it was executed, especially in light of the the work and counsel of military and civilian leaders like Shinseki and Powell, but it really wasn't a clear illegal act of preventative warfare and was actually quite cleverly executed within the nebulous bounds of the right of anticipatory self-defense. If you want to see some bad Bush Administration lawyering look at their reading of the Geneva Conventions, other international agreements and even US anti-torture legislation with regards to "illegal combatants." |

No. What I mean is that it's interesting how the Bush Administration arranged and presented it's strategy for preemptive war in such a way that was legal, could work unilaterally if the UN rejected it (as it did), and would still hold up as legal even if the evidence turned out to be dubious at best or even patently false (as much of it did). Personally, I always thought something was up when they acted like Hans Blix and the other weapons inspectors were incompetent morons and all the US weapons guys were so great. I also thought the yellow cake uranium stuff could have been handled in Africa without even having to deal with Iraq at all. And I was also really hoping they'd put htose resources to better use in Sudan and Darfur, so I was always against the Iraq War. But that doesn't mean I can't look at the international and military law in an objective way. |

Soldiers don't have the luxury of deciding which wars they want to fight. Their job is to go where they are told and follow orders that are not illegal or violations of the rules of war. As much as I disagree with the Iraq War, there is little evidence that there is criminal activity or war violations by US soldiers beyond the few aberrations like those few soldiers that killed that family so they could rape the daughter. And it is not that simple that it's not self-defense to fight Iraq. The evidence was bad, but most Americans didn't know that and most US soldiers didn't know that at the time. And the foreign policy logic is less clear cut, too. International law allows preemptive war against other sovereign nations, like the Six Day War. The problem is that it doesn't specify how soon that threat must be and what the threshold is for a "threat." Just because you disagree with the war doesn't automatically make it and the soldiers fighting it a war crime. |

As I have mentioned several times, US soldiers went into Iraq in good faith as part of a preemptive war and the vast majority have not committed any crimes under international or US law or violated any of the rules of war. And soldiers are not allowed to choose what wars they want to fight. If they do not follow orders they will be court martialed. They can only disobey orders if they are blatantly illegal under US or international law, like unjustly killing persons with protected status, intentionally going without uniform to hide among civilians, using poisons, etc. And you cannot be a volunteer and a conscientious objector. IF you have a problem with what is being done you follow the chain of command with your grievance. The US soldiers aren't Nazis committing crimes against humanity, they aren't hiding behind orders to justify their actions, their actions and orders are perfectly legal and nowhere near what the Nazis did in the war or in the Holocaust. |

You're not listening. Preemptive war IS ILLEGAL - end of story. No matter who you are or what country you are in, if you are ordered to make a first-strike against another country you are in violation of international law. Read the UN Charter some day. And you cannot be a volunteer and a conscientious objector. Of course you can. I could volunteer to fight to protect my country and then, at a later date, be ordered to do something illegal - invade another country. It is perfectly reasonable to be ready and willing to defend your country but, at the same time, be entirely unwilling to lay siege to another. The US soldiers aren't Nazis committing crimes against humanity Again, you're not listening. The Nazis weren't hung for "crimes against humanity" - they were hung for planning and waging an aggressive war. The Nuremburg defense is as invalid in the case of crimes against humanity as it is in the case of a war of aggression. Crimes against humanity are not the only way to violate international law. |

"Preemptive war" and "choice" and all the other horseshit you're horking out there has nothing to do with it, from the ground-level soldier's perspective. You act as if every private has to ponder every order like some sort of philosophy student. In fact, thinking is what gets soldiers killed at ground level. That's what the chain of command is for and why we have civilian oversight of the military--when the military is committed to an operation, there's never going to be 100 percent agreement on what is "right" and what is "wrong". Even in national defense! The military is an instrument. The hand that wields that instrument is the collective will of the American people as transmitted through their elected representatives. But you're not looking at context. First of all, if you have this period of reflection and decide not to go, you go straight to the fucking brig. Don't pass go, don't collect $200. Secondly, the soldiers relied on the civilians authorities to do the intelligence investigation. It's not the job of the average soldier to be an intelligence expert and know everything that is going on in the intelligence community and with regards to Iraq specifically. You need to delegate roles and soldiers just have to rely on the intelligence they get from the government. Soldiers will tell you frankly that intelligence often fucks up but I can't imagine that the majority of soldiers thought that the intelligence against Iraq was as poor as it really was at the time. And we really shouldn't expect them to because they aren't experts in the field and don't have the data to even begin to make assessments. I seriously doubt even guys near the top of the military command like Petraeus, Odierno, Shinseki, or anyone outside of the joint chiefs even had an inkling that the intel was so bad. Thus, it's hard to seriously criticize most of the soldiers for not challenging the Administration's assertions about Iraq. The blame really lies with the civilian leadership and Cheney in particular, but if you want to blame the soldiers for anything it probably should be at not being angry enough after the fact for being essentially deceived about the quality and veracity of the intel. |

http://www.cdi.org/news/law/preemptive-war.cfm Here's a great article about the legality of preemptive war, which essentially explores the meaning and legality of anticipatory self-defense in light of history, the UN Charter, the Iraq war, and other important considerations. Here are some important quotes: "To the extent the UN Charter can be deemed a relevant source of international law then some right of self-defense remains, which very well may include a right of anticipatory self-defense. " "The prevailing view probably is that, one way or another, anticipatory self-defense is permissible but traditionally has required the existence of an imminent threat." "One could argue that the rule does not actually require an attack to be imminent to act, but rather permits defensive measures to be taken before one passes a point in time when it is too late to prevent catastrophe. " "Such a point [earlier in the proliferation process of WMDs and a WMD attack], it is argued, could represent the presence of a danger justifying a "defensive" first-strike, perhaps when accompanied by other factors such as a history of aggression, ties to terrorism, or certain criminal activities by the target regime." |

This is especially true when most people in the military aren't actually active combat and many perform roles that don't involve killing people. Case in point, my cousin disarms IEDs, mines and other explosives in Iraq so that military personnel and civilians alike don't get maimed and killed by them. In fact, all the men in my family have been military vets except for me and my brothers, from medics to submarine mechanics to snipers to many other diverse roles and it pisses me off to see people denigrate them in various ways, especially by oversimplifying what it is to serve your country, be in a war, etc. |

I'm pretty sure that most of these people didn't sign up for the military to intentionally go to Iraq, they were already enlisted men and women who went where their superiors ordered them. But yeah, they're all criminals and accomplices to crimes because that's exactly how it all works and isn't at all a biased oversimplification of an extremely complicated issue. |

Yeah, the majority of US soldiers in Iraq and Afghanistan haven't committed crimes or war violations. They've abided by US military law, international law, the unofficial rules of war, etc. Just because you disagree with the war(s) doesn't automatically make what they are doing crimes. They are acting in good faith. |

Both wars are fundamentally in contravention to established international law. They are, in and of themselves, warcrimes. |
|
willrogers
said @ 7:10pm GMT on 22nd Jun
Please explain how they are war crimes. As I've already mentioned, Iraq was attacked as part of a perfectly legal war of preemption. Afghanistan was harboring and supporting terrorists. By supporting terrorists within their nation, the Taliban caused Afghanistan to lose its rights and protections under the Geneva Conventions, specifically the Third Convention. http://en.wikipedia.org/wiki/Third_Geneva_Convention Supporting the Al-Qaeda terrorists that attacked the US makes Afghanistan liable for the attack and it is as if Afghanistan attacked the US. Thus, the US was at war with Afghanistan because of 9/11, making that war a legal one of defense. Therefore, both Afghanistan and Iraq are technically legal wars that you just strongly disagree with, but again, that doesn't make them illegal. |

Iraq presented no danger whatsoever. It is ludicrous to think that Iraq was in any way capable of projecting power towards the US. If you want to talk about fantasy then forget it - you can justify anything you want if you don't care about reality. |
|

said @ 9:46pm GMT on 22nd Jun
It's not about "fantasy," you are ignoring the full context of what happened 2001-2003. Sure, the Bush Administration, especially Cheney's office, had a massive confirmation bias in just looking for proof of their belief that Iraq was a threat, but you have to look at it in light of 9/11. The belief wasn't that Saddam was only a threat via traditional warfare, but that his resources and WMDs would be utilized by terrorist proxies as with the Taliban and Al-Qaeda. I'm not saying that it was a very likely threat, just that it met the minimal standard of proof of the Bush Administration and Cheney in particular and therefore justified the preemptive war. There aren't really any hard and fast rules or laws against this policy or standard, so what they did was technically legal, but I personally think there should be from now on. If you read the article I posted in my other comment, the authors say that it is a somewhat dangerous precedent, but still technically legal, and that the international community should use this as a lesson and opportunity to more fully elucidate the bounds of self-defense and preemptive war, especially with the prevalence of WMDs and terrorism (which is much different post-Cold War). |

It shows how little he knows of the military. They are supposed to be apolitical. They are supposed to fight the wars they are given within the law and rules of war. They are supposed to do their duties and follow orders the best they can. They're not mercenaries that can leave when they aren't getting paid enough, are mistreated, or just don't want to fight, etc. If they disagree with the civilian leadership or their orders they can help vote them out of office when elections come around, just like any other American. It's an arduous, complicated life that I'm glad I don't have to take part in (yet?). |

The military's job is to be the most effective and efficient fighting force it can be, not decide policy. If the military is deciding policy then we've got a whole fresh set of problems. And more importantly, why shouldn't you be able to stop someone from attacking you before you've lost lives? And this is especially important with Iraq because they were believed to have restarted their nuclear program (albeit supported with poor intelligence) and if the first act of aggression that must occur before you can defend yourself is a nuclear attack then you are risking hundreds of thousands of lives at least. |

I personally don't believe this but it isn't really that far-fetched of an argument back in 2003. Saddam had a nuke program. He kicked inspectors out repeatedly. Many accused him of still having WMD programs. He was an aggressor in the region and an enemy of the US. North Korea fits this mold, too, and they have nukes, so I think that it was a somewhat legitimate fear to be worried about Iraq and nukes, especially with the amount of terrorism and instability in the region. |

The stable psychology is the one which refuses to aggress but will defend. |

Right, because self-preservation is such an evil thing. Yeah, killing is bad, but sometimes it had to happen to stop people from killing others. Even if it isn't done in defense of one's self, it is still justified by saving the life of another person. You are again completely ignoring the historical context that US soldiers were sent to Iraq under the auspices of fighting a preemptive war against Saddam. The evidence was shit but the soldiers did not know that, so they acted in good faith to defend themselves against a nation that had been an aggressor several times in the past few decades. Stop acting like all the soldiers knew it was a fake rationale and that all the evidence was shit at the time. They thought they were defending their country and others from Saddam Hussein. I'm not saying that we should have fought the Iraq War or anything close to that, but you keep arguing that these soldiers fought knowing they were there to advance Wolfowitz ideology and Bush's daddy issues. |

What the fuck are you talking about? Was every soldier supposed to request all the intelligence documents, photos and data that the Bus administration said supported their case before their tied their boots? They heard all the information about Iraq and had no reason to doubt it or think it was fabricated, they acted good faith. There was no failure on the part of US soldiers in "using their heads." It was the CIA's job to take care of the intelligence, not the military and especially not soldiers on the ground not tasked in any sort of intelligence role. You're just acting superior to anyone who doesn't agree with and/or doesn't/didn't act in the way you would. Any failure of the Iraq war was made in the Bush cabinet, not in the military. The Bush Administration fired or marginalized all the military guys that would have made things go better, like Shinseki and even Powell. |

I will kill for the Marines to the right and left of me. I will kill any enemy threatening my fellow Marines. This is not really clear thinking. Tell me that you can understand that the aggressive action of getting into an airplane and deploying half-way around the world - to take first action in threatening the brothers and families of other people - will make them want to protect themselves and fight you off. What worries me is the fragile criteria required for you to call someone "enemy". It doesn't seem like they have to do much. I only hope you never feel the need to land your planes on my soil and call me "enemy". I hope you never make me "threaten" your brothers to protect my own family. I can understand why you can't sleep at night, though. That I don't envy you. |

You are completely ignoring the historical context. The invasion began as part of a preemptive war against Iraq. Sure, it was shitty evidence of a threat, but none of the soldiers knew that. They were told that Iraq was a threat by various means and they were there to stop it. The majority of the soldiers treated the Iraqis in accordance with military law and the rules of war. Only a small portion of them were involved in the bad shit like killing civilians, torturing people, etc. The point of that Marine quote is that they will follow the lawful orders of their leaders and kill those who attempt to kill them while they are accomplishing those orders. |

For next years prom we need a better band, the drummer keeps missing his beat, the guitarist can only play a solo if he gets a do-over and the vocalist is equally good at what ever song he performs, the only propblem is he murders them all. We definitely need a higher female aspect in the female to male ratio as this is a weiner-fest and though some of us dudes would look good in a dress aint gonna help at all. Finally we need some form of play-pen for the politics, we're here to get drunk and have a quick fumble with that boy/girl/mascot you've been eyeing up for the past two years and never had the nerve to talk to.
